3.De beoordeling
“(…) During arrival inspection, we found that cu content of each load is much lower than contract spec.. In order to find the true, we started to make sampling for each load. Then we got the average Cu content is about 20.78%. For further consideration of the accuracy, we randomly choosed two loads for processing, but the actual result is some lower than sampling. (…)”
“As per you and our president Mr. [president Couger] ’s agreement, cu content loss would be calculated on finalized progress of 10 loads shelmo’s. Now we finalized the process of 10 loads and got a 20.49% cu recovery. It is even some lower than our sampling. So the claim amount for cu loss is $ 265,899.50 (…)”.
“(…) In order to determine the real Cu-content of all 30 loads, samples has been made of each container. To test whether the samples are applicable, ten loads were randomly chosen for further consideration of the accuracy (further details see annex). The average Cu content was determined by 20,71%, which caused a Cu difference of 4,29% i.e. 33,3 tons of pure copper compared to contractual agreement. This lead to a total damage of € 209.300,- based on current market price at that time, which Europe Metals had to compensate to the customer.(…)Please pay the total amount of € 209.300 within 7 days or agree in written to offset this amount with current vendor balance based on previous deliveries.(…)”
