Your employment with[Marriott]
was terminated on October 14, 2013 due to urgent reasons.As we discussed with you, the company was informed by security that when leaving work on Sunday October 6, 2013 your breath smelled of alcohol.(…) October 8, 2013, (…) your were suspended pending investigation as there was suspicion that joy had been working under the influence, this you denied.During the investigation, the company established that your shift report contained typing errors and certain inconsistencies.On Wednesday October 9, 2013 you were heard by your manager, [ ], Director of Engineering, [ ] and Director of Human Resources Operations, [ ]. You stated that you had not drunk any alcohol on the previous Sunday during working hours. You were not able to give a valid explanation for the witness statements that your[breath]
smelled of alcohol. When questioned what you did during the two hours you had worked overtime that Sunday, you could not give a valid explanation. In addition you found it hard to recall the tasks you had completed during your shift and who were the colleagues that we working with you on that day, while you were supervisor in charge. You did explain that together with your colleague you stayed in the Engineering bulb room for about forty minutes to work on a door cylinder. You also denied coming to work under the influence and having consumed alcohol during working hours. You confirmed that you were aware of our substance abuse policy and that you received a refresher in September 2013 about this policy. You were informed that you would stay suspended pending investigation while the company finalized the investigationWhen receiving the tapes of the Engineering bulb room storage area it was clear to the company that together with your colleague you entered the Engineering bulb room storage area several times during your shift and not only one (1) time like you mentioned in previous meetings. The company considered that this particular storage area is a small space, generally smells like mildew and is considered very hot. Each time you entered into the storage area the door appeared closed behind you. The first time you entered you stayed in there or about nine minutes; the second time for about ten minutes; the third time about one hour and a half.; the fourth time for about forty-five minutes and the fifth time you stayed for about thirty minutes. The fourth and fifth time you were working overtime hours. The company notices that your colleague behavior was changing during your shift and the he at one point lost his balance and you held him.We met again on Thursday October 10, 2013 and you insisted that your statements of October 8th and 9th were the truth. However, you added that you now recalled that before arriving to work on Sunday October 6, 2013 you drank a Guinness of Stout full house and this may be the reason that your breath smelled of alcohol. After being informed of the tape seeing you enter the storage area, you also now admitted that it was not once you entered the Engineering bulb room; You stated that you had entered one time to work on a door cylinder and the other time to look for the stored items of Tradewinds Club. After presenting you with more facts of the video footages you informed us that you smoked a cigarette in the Engineering bulb room and threw it on the Casino ceiling. You confirmed that you knew this was against the policy (…).On Friday October 15, 2013 we met again (…) You also told us that you did notice that your colleague’s breath smelled of alcohol but that you did not see him drinking during his shift. When we informed you that your colleague had confirmed that both of you had drunk alcohol in the storage room during working hours, you changed your story again and informed us that you did see your colleague drinking during his shift. When asked if you suspended or reported this colleague for drinking alcohol you replied that you didn.t drink together with hjm You admitted that you are aware that in you role as supervisor you should not have permitted his drinking alcohol and should have immediately suspended him pending investigation.(…)
The company concluded the investigation om Monday October 14, 2013 and met with you on that day. You were informed that your actions of October 6, 2013 as described above:- working overtime without a valid reason and/or- allowing your colleague to work overtime without a valid reason, and/or- loitering on the job, and/or- smoking in an area that is not permitted and/or throwing a cigarette bud anywhere but in the designated trashcans, and/or- allowing your colleague to drink alcohol without taking action,have caused the Company to lose all trust in you and constituted individually and jointly an urgent reason for the immediate termination of your labor agreement as per October 14, 2013. This was all informed to you on October 14, 2013.
