I had under my responsibility to refurbish the ‘Coke Handling Facilities’ and needed someone to safeguard the safety of the refurbishment of the work surrounding the coke and sulfur handling. Since all of the refinery technical(safety) individuals were already committed to other parts of the refurbishment, I thought that this would be a good time to loan someone from the airport the refinery to fill the safety coordinator’s role since that person has a lot of safety training. Then. I remembered the conservation I had with [eiser]. […] I chose him and thus removing tension at the airport.
With this letter I agree and accept that I will not receive any shift differential payment for the period of August 18. 2010 to November 2010 on which I will be assigned as a Solid Handling Technician in the Economics and Planning department.’
Mr. [eiser] and I talked at least once about his situation and I remember clearly that during the implementation of the social plan upon the closure of the Aruba Refinery that mr. [eiser] approached me about getting a termination package similar to the ones Valero was offering to refinery employees because he did not want to go back to the airport. I told him that those termination package were only being offered tot Valero Aruba refinery employees and not to VMSA employees. I mentioned that he, in time would have to go back to the airport and work his job as a fueler again’.
