can be applied to the decision that the banking relationship does not have to be continued. After this, a number of court procedures were started by your clients in an attempt to overturn this judgement. They were not successful in their endeavors. In particular, by judgement of March 24, 2015, the Court of First Instance ruled that there were no grounds to revoke the judgement of October 29, 2013. The appeal to this judgement was unsuccessful because of the prohibition to appeal judgements regarding the revoking of another judgement (Court of Appeals, June 10, 2016). In yet another court case that was initiated by your client, the Court of First Instance ruled on May 19, 2015 that (z) had to continue the banking relationship until that judgement becameres judicata
. On December 15, 2017 the Court of Appeals confirmed the judgement in first instance, making itres judicata.
As such, since October 29, 2013 it was abundantly clear that (z) had rightfully terminated the banking relationship and that it was allowed to close the accounts. This was subsequently confirmed by the Court of Appeals on June 10, 20-16 and December 15, 2017.

dienthet Gerecht de conclusie te trekken dat voor zover het betreft de bancaire rechtsverhouding tussen (x) en (z) dat (z) bij brief van 15 februari 2013 de bankrelatie/bankrekening-overeenkomst met (x)
rechtmatigen
in overeenstemming met de vereisten van de redelijkheid en billijkheidheeft opgezegd. [4] De stelling dat (z) door de opzegging haar zorgplicht jegens (x) schendt, passeert het Gerecht dan ook.
-dan wel drie maanden later [14] - het op de weg van (x) lag om deze initiatieven te nemen en niet op de weg van (z); [15] ook niet op grond van de door (z) jegens (x) in acht te nemen zorgplicht.
