Tijdens de descente heeft NLGY naar het voorlopig oordeel van het Gerecht voldoende aangetoond dat zij na het vonnis van 16 december 2025 in ieder geval is begonnen met werkzaamheden, die tot de aanleg van de toegangsweg moesten leiden.
NLGY heeft daarnaast in deze procedure een recent rapport van 23 januari 2026 van de Fire Department in het geding gebracht. Voor zover relevant luidt dat rapport als volgt:
The purpose of the inspection was to determine whether the proposed access road to the residences adjacent to the project would be acceptable for emergency services. The proposed road was intended to pass through the construction site and over the excavated area. With the assistance of a drone and a physical inspection, the Fire Department assessed the location.
Based on safety considerations for our personnel and equipment, we have concluded that the proposed road through the worksite—intended to provide access to the residences adjacent to the site—will not be used.
At this point the proposed road is not feasible, a timeline for completion of the underground garage would have to be set for a follow-up inspection of a new road proposal.
Furthermore, as the site will remain active with ongoing construction and the presence of building materials, access through the worksite would create an unsafe environment for emergency services, construction workers, and pedestrians. For these reasons, the Fire Department does not agree with the newly proposed access.
In the event of an emergency, the Fire Department will stop at the entrance of the construction site and deploy hoses to the residential buildings along the easement (…), or
to the construction site, as stated in the letter dated January 22, 2025 In the event of a medical emergency, the Fire Department will assist the ambulance service with the
lifting and transfer of patients from residences to the ambulance, where services allow.
