2.12Bij e-mail van 5 juli 2022 heeft de heer [medical officer], Medical Review Officer van Medwork, onder meer het volgende aan Hyatt bericht:

Candidate will be explained that a Breath Alcohol test will be performed.
A fresh sample tube will be placed in the breath analyzing machine. All sample tubes are separately seal-wrapped and are disposed of immediately after de test. Machine will be activated and candidate will be shown how the machine first calibrates itself by use of ambient air.
This so called Blanc Check will verify that no alcohol is found in the ambient air and that the machine indicates 0 ug/L.
After this Blank Check the candidate is instructed to inhale deeply and then slowly and steadily exhale into the sample tube. The machine starts measuring after a first volume of air has passed through the machine.
This is to prevent possible residual air from contaminating the test and to measure alcohol content of deep lung breath only.
Once the test is completed the machine will indicate the amount of alcohol found on the screen and these results or immediately printed in hard copy. This printout should be attached to the Medwork testform.
After this, the candidate is instructed to sit and wait in the waiting area for at least 15 minutes and will be asked to not eat or drink during this waiting period. After this 15 minutes interval the test will be repeated by using the same procedures as described here above. These procedures are not laid down in written procedures by us , but follow the online training for alcohol breath specimen collection by the manufacturer of the device.
2. On march 31 2022 the test for Bergen was performed following the above mentioned procedures. (…)
3. After completing the test, candidate was informed about the results and was shown the result on the printout.
4. The 387 ug/L indicates that the candidate has consumed and digested alcohol in the hours prior to the test taken, It also indicates that the candidate can be considered ‘under the influence’ of alcohol at the time the test was taken.
5. Our alcohol tests are performed by use of the Alco-Sensor V by manufacturer Toximeters. The machine is calibrated by our local DTI once a year and this calibration is currently valid until October 2022. It is further good to realize that this machine is a so called ‘self calibrating’ device which does a blank check (see above) at the start of each test.”
