Op 27 januari 2004 lag de “Spring 1” nog steeds in Las Palmas. Toen heeft een bespreking plaatsgevonden tussen Davof en Achmea. Naar aanleiding daarvan heeft Davof ten behoeve van Achmea opdracht gegeven aan Etas Expertises B.V. (hierna: Etas) tot onderzoek van de partij PKE-meel aan boord van de “Spring 1”. Na onderzoek op 4 en 5 februari 2004 berichtte expert R.C. Wijnja van Etas in zijn rapport van 11 februari 2004 onder meer het volgende:
“a- Ownership of the vessel had changed. [..]
b- No wages had been received for over 7 months and the families at home were desperate.
c- There were no more stores / provisions on board and the crew survived by gifts from crews of other vessels and charity by the local Red Cross.
d- There was approx. 1,500 litres of Diesel oil left on board. [..]
It appeared that the relevant ship’s certificates had already been expired on January 15th 2004 and we found the vessel to be poorly maintained requiring various repairs but spare parts were lacking. [..]
We found the cargo at the height of the lower-edge of the coaming with a slope in the forward area running down tot tank top level against the forward bulkhead. The cargo appeared to be mingled with woven polyethylene bags as well as with loosed strings of polyethylene and on the surface of the bulk we noticed pollution by rust scales. These scales had dropped down from the underside of the hatch covers. Furthermore we found pieces of paper against the sides onto which tablets of Aluminium Phosphide fumigant had been placed.
We ascertained the sweat gutter on the coaming table as well as the under-side of the hatch-cover and inner-side of the coaming were completely dry (no development of sweat and / or any traces of water-ingress whatsoever).
The cargo gave a normal smell and the surface of the bulk in this compartment appeared to be in a good order and condition [..]
We have measured the temperatures of the cargo in the forward area up to a depth of approx. 0.75 metres below the surface and we found the temperatures over here ranging between +22ºC and +24ºC. [..]
Again we did not find any traces of sweat inside the hatch or any ingress of water (gutter on table, under-side of hatches and inner-side of coaming completely dry). We found the cargo stowed and trimmed inside the coaming with a slope in the aft area running down from the lower-edge of the coaming towards the engine-room bulkhead. Apart from rust scales (from the under-side of the hatch) and strings of polyethylene, we did find the (top of the) cargo inside this no 2 hatch as well as in the aft area below deck in an apparent good order and condition. [..]
By means of a shovel we dug a hole on the top of the cargo and at a depth of approx. one metre and we measured a temperature inside the bulk to be +27ºC. [..]
Meanwhile market prices for the commodity have gone up. We roughly estimate the current sound market value at maximum Euro 120.00 per metric ton, being for the shipment a total amount beyond Euro 100,000.00 *CIFFO port in Spain/Portugal* .
However to deliver the cargo to a continental destination will be difficult if not impossible at all, especially for economical reasons.
As far as we can see owners are unreliable and we anticipate that, although Port State Control had meanwhile reduced the points of repair which need to be fixed, such repairs may not be effected for economical reasons, especially not since bunkers and provisions are urgently required and also approx. 7 months wages for 9 crewmembers still have to be paid and port expenses at Las Palmas are due and daily increase. [..]
Options may be:
1- Trans-loading the cargo into another vessel in the port of Las Palmas, which we deem practically impossible [..]
2- Disposal of the cargo to a (preferably local) buyer, which will undoubtedly result in a huge depreciation if there are prospective buyers al all, since there is no or hardly any market for this commodity on the Canary Islands. [..]
Moreover the Port Authorities of Las Palmas have to approve such discharge and / or trans-loading activity and as we understand it, their co-operation with such activities will not be given without considerable securities (we were advised that Euro 200,000.00 had been requested). [..]”
