on the methods for calculating the 3m² of personal space: Regarding the methods used to calculate individual space, we can inform you that in all French prisons, cell capacity is determined by the circular of 16 March 1988 based on the floor area of the room. The surface area of the sanitary facilities is therefore included in the surface area of the room, depending on technical constraints, and varies between 1.4 and 1.8 m².
regarding the review of the situation of prisoners undergoing gender transition: if the person concerned requests it immediately, the multidisciplinary commission meets to review the individual situation of the prisoner within a period ranging from 4 to 8 days after her incarceration. Based on all the information gathered by the members of the multidisciplinary team, the terms of care are examined at this time. With regard to transfer times once the commission has made its decision, if the detainee is assigned to a prison with separate wings for men and women, as is the case in Nice, there is no specific procedure to be followed other than obtaining authorization from the magistrate in charge of the proceedings. However, as already mentioned in our previous letter, we are unable at this stage to answer questions concerning the outcome of the multidisciplinary committee's decision.
On freedom of movement outside the cell: current regulations in France stipulate a minimum of one hour of outdoor exercise per day for prisoners. However, outdoor exercise is generally organized as two hours of planned walking in one or two sessions spread throughout the day, to be adjusted according to weather conditions.”
