the Regional Court in Kielce, 3rd Criminal Division(Polen) op 19 mei 2023 en betreft:
1.Beoordeling
On behalf of the court is requested to practically give the surrendered person the opportunity to make known all possible comments and objections with respect to the request for additional consent (cf. ECJ EU 26 October 2021, C-428/21 PPL) and C-429/21 PPU, ECLI:EU:C:2021:876, para. 63), and to forward the written record thereof to the court. In other words, the court requests to hear the surrendered person (or have her heard) about the request for consent and, in that context, to ask her whether she has any objections to the Netherlands granting this request and, if so, what objections. The mere communication that the surrendered person does not wishes to waive the protection of the specialty principle is not sufficient.”
the Regional Court in Kielce, 3rd Criminal Divisionop 25 april 2023 staat, voor zover relevant, het volgende:
The convict [de overgeleverde persoon] states that she has understood the advice and does not waive the specialty rule and does not want for an alternative penalty of imprisonment in place of an unpaid fine in a case ref. III Ko 327/19 to be enforced.”
the Regional Court in Kielce, 3rd Criminal Divisionop 16 mei 2023 staat, voor zover relevant, het volgende:
The convict [de overgeleverde persoon] states that she has understood the advice and does not waive the specialty rule.”

wijst het verzoek af.
