Throughout the duration of the employment contract and for a period of 12 months after termination thereof, regardless of the reason and/or manner of termination, the employee shall, except after Employer’s prior permission:
not be engaged, involved or have an interest in any matter, directly of indirectly, whether on the account of the Employee or on the account of third parties, in any person or enterprise which conducts activities in a field similar to or otherwise competes with that of Employer (…) or for or in favour of relations with which Employer had business contact during the term of employment, nor act, directly or indirectly, as intermediary in relation to such activities in whatever manner, and/or;
refrain from performing paid or unpaid activities (…);
refrain from doing business or maintain any form of business contact (…);
refrain from setting up a company that competes or which conducts activities in an similar field with the Employer company or an associated company (…).

Beoordeling
Verboden zijn overeenkomsten tussen ondernemingen, besluiten van
ondernemingen. Nergens blijkt van de bedoeling dat deze beperking tot drie jaar, waarbij heeft te gelden dat ook wel langere periodes gerechtvaardigd kunnen zijn (vgl. noot 21 onder deze Mededeling) eveneens van toepassing is op arbeidsrechtelijke verhouding van bij die concentratie betrokken werknemers.
