“1. Please by informed that we cannot say in advance in which prison [opgeëiste persoon] will be held in the event of his surrender to the Republic of Lithuania pursuant to the European Arrest Warrant […] (hereinafter referred to as the EAW). It should be noted that persons surrendered to the Republic of Lithuania under an EAW are initially conveyed to Vilnius or Kaunas prison. If the remand in custody is extended, [opgeëiste persoon] will be held in the prison of the jurisdiction of the court which issued the precautionary measure.
Please note that sentenced persons are sent to specific places of detention taking into account the length of the sentence, the dangerousness and nature of the offence committed, the health, psychological characteristics, age, ability to work, profession, and, where possible, the permanent place of residence of the convicted person or of the person’s relatives. For this reason, we cannot say in advance to which prison [opgeëiste persoon] will be assigned if he is sentenced to imprisonment. […]
2. It is noted that teams of contact officer have been formed in prisons ensuring that one contact officer works directly with no more than 30 prisoners.
3. Lithuania is a law-abiding country in the European Union. Prisons comply with Article 3 of the European Convention for the Protection of Human Rights and fundamental Freedoms of 4 November 1950 and Article 4 of the Charter of Fundamental Rights of the European Union.
We want to ensure that prison staff do not tolerate any ill-treatment among prisoners. The psychological climate among detainees/convicts is constantly monitored in all prisons in order to identify and prevent possible threats or criminal acts. If a prisoner experiences ill-treatment, is threatened or feels unsafe, he or she can contact the prison authorities directly at any time. Prison staff who observe any signs of violence, including verbal and psychological violence, among detainees or prisoners are obliged to investigate the situation and take action to prevent violent acts. Please note that in all such cases, an internal investigation shall be initiated and the detainee shall be immediately placed in isolation (i.e. in a single cell or in another secure environment) while his/her complaint is investigated. If the prisoner’s allegations are confirmed, he/she shall be transferred to another sector of the prison or to another prison.
We would like to stress that the Lithuanian authorities are responding to the comments made by the European Committee against torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and are taking urgent measures to improve the situation. […]”
