Procesverloop
Overwegingen
gehelein 2014 verdiende loon onder artikel 15, derde lid, van het belastingverdrag valt, en dat de heffing daarover volledig toegewezen is aan Zwitserland. Niet in geschil is namelijk dat het loon van eiser over 2014 volledig is verdiend met een dienstbetrekking die is uitgeoefend aan boord van [naam schip] en dat de werkelijke leiding van de onderneming in Zwitserland ligt. Als het gelijk aan eiser is, moet verweerder dus aftrek elders belast verlenen ter zake van het gehele in 2014 verdiende loon.
[naam schip] verricht geen vervoer in deze zin, maar neemt alleen voorraad mee (de pijpsegmenten) ten behoeve van de constructiewerkzaamheden op zee. Op eisers loon is daarom niet artikel 15, derde lid, van het belastingverdrag van toepassing. Nederland is (met uitzondering van het loon ter zake van Noorwegen) heffingsbevoegd.

3 Niettegenstaande de voorgaande bepalingen van dit artikel mag de beloning verkregen ter zake van een dienstbetrekking uitgeoefend aan boord van een schip of luchtvaartuig dat in internationaal verkeer wordt geëxploiteerd, of aan boord van een binnenschip, worden belast in de Verdragsluitende Staat waar de plaats van de werkelijke leiding van de onderneming is gelegen.”
The term “international traffic”
5. The definition of the term “international traffic” is based on the principle set forth in paragraph 1 of Article 8 that the right to tax profits from the operation of ships or aircraft in international traffic resides only in the Contracting State in which the place of effective management is situated in view of the special nature of the international traffic business. However, as stated in the Commentary on paragraph 1 of Article 8, the Contracting States are free on a bilateral basis to insert in subparagraph e) a reference to residence, in order to be consistent with the general pattern of the other Articles. In such a case, the words “an enterprise that has its place of effective management in a Contracting State” should be replaced, by “an enterprise of a Contracting State” or “a resident of a Contracting State”.
1. The object of paragraph 1 concerning profits from the operation of ships or aircraft in international traffic is to secure that such profits will be taxed in one State alone. Operation in international traffic means any operation of ships or aircraft which extends over more than one country, whatever the number of places of call in a particular country. The provision is based on the principle that the taxing power shall be left to the Contracting State in which the place of effective management of the enterprise is situated.This makes it unnecessary to devise detailed rules, e.g. for defining the profits covered, this being rather a question of application for which general principles of interpretation must be taken into account. It seems useful, however, to give a few examples and comments to clarify the question.
1. The object of paragraph 1 concerning profits from the operation of ships or aircraft in international traffic is to secure that such profits will be taxed in one State alone. The provision is based on the principle that the taxing right shall be left to the Contracting State in which the place of effective management of the enterprise is situated. The term “international traffic” is defined in subparagraph e) of paragraph 1 of Article 3.

The object of the third paragraph of Article 15 is to apply to the remuneration of crews of ships or aircraft in international traffic, or of boats engaged in inland waterways transport, a rule which follows up to a certain extent the rule applied to the income from shipping, inland waterways transport and air transport - that is, to tax them in the Contracting State in which the place of effective management of the enterprise concerned is situated. This provision assumes that the internal law of that State allows it to tax the remuneration of a person in the service of the enterprise concerned, irrespective of his fiscal domicile. It is understood that paragraph 3 of Article 8 concerning shipping, inland waterways transport and air transport, is applicable if the place of effective management of a shipping enterprise or of an inland waterways transport enterprise is aboard a ship or boat.”
9. Paragraph 3 applies to the remuneration of crews of ships or aircraft operated in international traffic, or of boats engaged in inland waterways transport, a rule which follows up to a certain extent the rule applied to the income from shipping, inland waterways transport and air transport, that is, to tax them in the Contracting State in which the place of effective management of the enterprise concerned is situated. In the Commentary on Article 8, it is indicated that Contracting States may agree to confer the right to tax such income on the State of the enterprise operating the ships, boats or aircraft. The reasons for introducing that possibility in the case of income from shipping, inland waterways and air transport operations are valid also in respect of remuneration of the crew. Accordingly Contracting States are left free to agree on a provision which gives the right to tax such remuneration to the State of the enterprise. Such a provision, as well as that of paragraph 3 of Article 15, assumes that the domestic laws of the State on which the right to tax is conferred allows it to tax the remuneration of a person in the service of the enterprise concerned, irrespective of his residence. (…)”

nietin het belastingverdrag beschreven begrip aangesloten te worden bij het nationale (belasting)recht van de staat die het belastingverdrag aan het toepassen is. Het begrip ‘internationaal verkeer’ is echter
welomschreven in het belastingverdrag, namelijk in artikel 3, eerste lid, onderdeel g (zie 12.). Dat betekent dat die omschrijving leidend is voor de interpretatie. Dat is ook logisch, omdat het niet de bedoeling van een belastingverdrag is dat beide staten eenzelfde begrip op een andere manier uitleggen. Dat zou voor problemen zorgen die het belastingverdrag nu juist beoogt op te lossen. Om deze reden kan eisers beroep op de uitleg van het begrip ‘internationaal verkeer’ naar Nederlands, nationaal recht (conform de betekenis binnen het tonnageregime) niet slagen. De rechtbank zal deze uitleg dan ook buiten beschouwing laten.
The profits covered consist in the first place of the profits directly obtained by the enterprise from the transportation of passengers or cargo by ships or aircraft (whether owned, leased or otherwise at the disposal of the enterprise) that it operates in international traffic. However, as international transport has evolved, shipping and air transport enterprises invariably carry on a large variety of activities to permit, facilitate or support their international traffic operations. The paragraph also covers profits from activities directly connected with such operations as well as profits from activities which are not directly connected with the operation of the enterprise’s ships or aircraft in international traffic as long as they are ancillary to such operation.”

Door het gebruik van de termen 'passengers' en 'cargo' is duidelijk dat de OESO gedacht heeft aan klassieke vervoerssituaties, zoals op zee bij cruiseschepen, veerboten, vracht- en containerschepen het geval is. De verruiming die daarna (in de tweede en derde zin) volgt, betreft andere activiteiten die ondersteunend en dienstbaar zijn aan of direct verbonden zijn met het vervoeren van die passagiers of goederen als zodanig. Er is dus geen sprake van het uitbreiden van term ‘internationaal verkeer’ naar andersoortige activiteiten dan het vervoeren van passagiers of goederen. In het commentaar worden ook uitsluitend voorbeelden genoemd die betrekking hebben op goederen- en personenvervoer in deze zin. Kortom: het gaat er in deze uitleg om, dat vervoersactiviteiten de core business van het bedrijf vormen. Als dat eenmaal zo is, vallen ook opbrengsten van daarmee samenhangende of daaraan dienstbare activiteiten onder de toewijzingsregel. Andersom werkt het echter niet: ondersteunend vervoer alleen is niet genoeg voor de toepassing van deze bepaling.

Vanwege die bijzondere aard zouden winsten – en in het verlengde daarvan ook de beloningen van opvarenden – alleen belast moeten worden in de staat waar de werkelijke leiding van de onderneming is gelegen (zie 16. en 19.).
1963was nog geen aparte definitie voor het begrip ‘internationaal verkeer’ opgenomen. Voor de uitleg van dit begrip was alleen het commentaar bij artikel 8 beschikbaar Pro, waarin onder meer het volgende was opgenomen:

De oorzaak van die problemen ligt in de bijzondere aard van de bedrijfsactiviteiten, die vanwege de constante fysieke verplaatsing over de wereld een voortdurende doorkruising van fiscale jurisdicties met zich brengt. Kijkend naar de uitleg van het begrip ‘internationaal verkeer’ in het commentaar bij het oorspronkelijke OESO-modelverdrag (zie 49.) is de bepaling oorspronkelijk ook zo bedoeld geweest. De bepaling is naar het oordeel van de rechtbank oorspronkelijk geschreven voor personen die als bemanningslid op een schip of vliegtuig werkzaam zijn dat verschillende landen aandoet, ongeacht de precieze activiteiten van dat schip of vliegtuig. De nadruk ligt in dat eerste commentaar op de
'operation', dus de exploitatie:
'any operation (…) which extends over more than one country'geldt als exploitatie in 'internationaal verkeer'. De term 'vervoer' uit de huidige definitiebepaling van artikel 3, eerste lid, onderdeel g van het belastingverdrag moet tegen deze achtergrond volgens de rechtbank worden gelezen als 'verplaatsing'. Elke verplaatsing van een schip of vliegtuig waarbij een landsgrens wordt overschreden, geldt als 'vervoer' en daarmee als 'internationaal verkeer' in de zin van het belastingverdrag.
