3.1.In dit hoger beroep kan worden uitgegaan van de volgende feiten.
a. [appellant] , geboren op [geboortedatum] 1968, is vanaf 9 juli 2009 in dienst geweest van XPS, aanvankelijk in de functie van Strategic Purchaser en met ingang van 1 juli 2010 in de functie van Purchase Manager.
b. XPS heeft, na daartoe op 26 februari 2015 verkregen toestemming van het UWV, de arbeidsovereenkomst met [appellant] opgezegd per 1 april 2015.
c. [appellant] heeft XPS vervolgens meermaals verzocht om een “job certificate”.
d. XPS heeft een “Working certificate” van 18 mei 2015 afgegeven, waarin onder andere is vermeld:
“(…) Mr. [appellant] was responsible for the purchasing of empty cartridges for our production facility in Slovakia. Mr. [appellant] was employed at the headquarters of XPS b.v. in [vestigingsplaats] , the Netherlands.
The function of Mr. [appellant] was Purchase Manager Xiclado and did involve especially: (…) Mr. [appellant] was also involved in a few project teams. For example: (…). And Mr. [appellant] was also responsible for consolidation of > 10 forwarders back to 2 forwarders.
Mr. [appellant] did the duties assigned to him always to our complete satisfaction. The agreed objectives were exceeded by Mr. [appellant] . Mr. [appellant] was equally popular and appreciated for his friendly nature and his collegial attitude from supervisors and employees. Mr. [appellant] has stopped working for our company on 31 March 2015 as due to automation of the ERP system the job of Mr. [appellant] did not exist any longer. We thank Mr. [appellant] for his service and wish him every success for the future. (…)”.
e. [appellant] heeft bezwaar gemaakt tegen het “Working certificate” van XPS en een eigen versie van een “Job Reference” in concept aan XPS toegezonden.
f. XPS heeft vervolgens, aan de hand van het door [appellant] verstrekte concept, een ander “Working certificate” van 17 augustus 2015 aan hem verstrekt. Hierin staat onder meer:
“(…) Mr. [appellant] worked as a freelancer for XPS’s sister company Xiclado in June 2009. His task was the purchase of empty toner cartridges needed for the XPS production facilities in Slovakia and China (…). Mr. [appellant] ’s purchasing strategy resulted in an annual cost reduction of 26.2% (…). From 9 July 2009, Mr. [appellant] was hired for a period of one year as Strategic Purchaser to restructure the Xiclado purchasing of empty cartridges and to ensure the cost reduction established in July for a longer term period. Mr. [appellant] put a solid structure in place for Xiclado’s purchase and sale of empty toner cartridges, focusing on key vendors in XPS/Xiclado’s main market in Germany.
The main focus area of Mr. [appellant] was vendor management. (…) After successfully restructuring of the purchase department at Xiclado and due to his excellent performances, Mr. [appellant] became Purchase Manager of Xiclado with effect from 1 July 2010. Simultaneously, his one year contract was transformed into an employment contract of indefinite duration. (…) In his position as Purchase Manager, Mr. [appellant] was besides the purchasing of empty cartridges also as Project Manager responsible for the international projects “European Pallet Transports” and “Reallocation of Packaging” of sister company XPS. (…) Based on the new logistic footprint and due to Mr. [appellant] ’s logistic tender, Mr. [appellant] was able to reduce the number of forwarders from more than 10 international frequently used forwarders to only 1 Slovakian and his negotiated annual fixed prices result in a freigt cost reduction of 12,2%. (…)
All in all, Mr. [appellant] led both ambitious projects in all its aspects towards a very successful upshot. The focus of Mr. [appellant] ’s professional activity at XPS includes the following tasks and responsibilities:
• Worldwide strategic and operational procurement of empty cartridges (…)
• Vendor visits, attending fairs and exhibitions (e.g. REMAX/Paperworld in Dusseldorf and Frankfurt) (…)
Mr. [appellant] was always on time and is a self-motivated, hard-working, global orientated and entrepreneurial thinking and acting employee. He carried out every aspect of his work to the highest possible standard, always meeting in- or external requirements and exceeding our objectives in a very professional and timely manner. Mr. [appellant] is a creative problem-solver and has a broad range of skills in the area of logistics and trading of empty cartridges. Mr. [appellant] handles responsibility very well, has excellent communication and negotiation skills, anticipates the needs of others and always took an active role in our management team. Mr. [appellant] ’s pleasant manner and his collegial attitude made him very popular with superiors, colleagues and the rest of the staff. I can give him the highest possible recommendation to any future employer. The activities of XPS/Xiclado are already for several years being restructured due to economic reasons. As a consequence many functions have been in depth automated in the ERP system. XPS terminated Mr. [appellant] employment contract as of 31 March 2015 due to economic reasons. We regret this development very much and thank Mr. [appellant] . (…).”.
3.2.1.In de onderhavige procedure in kort geding vordert [appellant] , voor zover mogelijk uitvoerbaar bij voorraad, veroordeling van XPS tot afgifte dan wel ter beschikkingstelling van een getuigschrift, waarin de tekst identiek is aan die welke in concept eerder door [appellant] is opgesteld, op straffe van een dwangsom en met veroordeling van XPS tot betaling van de buitengerechtelijke incassokosten en de kosten van deze procedure.
3.2.2.Aan deze vordering heeft [appellant] , samengevat, het volgende ten grondslag gelegd.
In de hernieuwde versie van het getuigschrift staan feitelijke onjuistheden en/of onvolledige informatie. XPS weigert het getuigschrift aan te passen dan wel te veranderen. Zolang [appellant] niet in het bezit is van een deugdelijk getuigschrift, wordt hij belemmerd in zijn mogelijkheden om bij andere (internationaal opererende) bedrijven te solliciteren.
3.2.3.XPS heeft gemotiveerd verweer gevoerd. Dat verweer zal, voor zover in hoger beroep van belang, in het navolgende aan de orde komen.
