De advocaat van Palladyne heeft schriftelijk op die conclusie gereageerd.
Libyan Investment Authority(hierna: de LIA), een entiteit van de staat Libië, US$ 300 miljoen geïnvesteerd in Upper Brook, een op de Kaaimaneilanden gevestigd investeringsfonds dat destijds het Palladyne Global Diversified Portfolio Fund Limited heette. Daarnaast hebben twee andere entiteiten van de Libische Staat US$ 400 miljoen geïnvesteerd in twee andere fondsen (alle fondsen hierna tezamen te noemen: de Upper Brook Companies).

Investment Management Agreementis bepaald dat Palladyne voor haar werkzaamheden recht heeft op een managementvergoeding van 0,6255 van de
Net Asset Value of the Sharesper kwartaal.
Investment Management Agreementtoekomen, te laten voldoen uit de bij Deutsche Bank in bewaring gegeven vermogens van (uiteindelijk) de Upper Brook Companies.

Investment Management Agreementmet Palladyne met onmiddellijke ingang te beëindigen. Namens Upper Brook hebben zij Palladyne vervolgens brieven gezonden, althans doen zenden, die strekken tot beëindiging van de
Investment Management Agreementmet onmiddellijke ingang.
Government of National Accord(hierna: GNA) – die de steun heeft van onder meer de VN – accepteert en de GNA de vraag naar het leiderschap over de LIA beantwoordt. Deze schorsing duurt tot nader order voort.

Asset freezeis in paragraaf 17 van deze resolutie het volgende bepaald:
Decidesthat all Member States shall freeze without delay all funds, other financial assets and economic resources which are on their territories, which are owned or controlled, directly or indirectly, by the individuals or entities listed in annex II of this resolution or designated by the Committee established pursuant to paragraph 24 below, or by individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them, and decides further that all Member States shall ensure that any funds, financial assets or economic resources are prevented from being made available by their nationals or by any individuals or entities within their territories, to or for the benefit of the individuals or entities listed in Annex II of this resolution or individuals designated by the Committee;”

Expresses itsintention to ensure that assets frozen pursuant to paragraph 17 shall at a later stage be made available to and for the benefit of the people of the Libyan Arab Jamahiriya;”
asset freezebetrekking heeft, behoren de inmiddels overleden voormalige leider van Libië, Muammar Kadhafi, en zijn kinderen.
Asset freezeis daarin onder meer bepaald:
Decidesthat the asset freeze imposed by paragraph 17, 19, 20 and 21 of resolution 1970 (2011) shall apply to all funds, other financial assets and economic resources which are on their territories, which are owned or controlled, directly or indirectly, by the Libyan authorities, as designated by the Committee, or by individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them, as designated by the Committee, and
decides furtherthat all States shall ensure that any funds, financial assets or economic resources are prevented from being made available by their nationals or by any individuals or entities within their territories, to or for the benefit of the Libyan authorities, as designated by the Committee, or individuals or entities acting on their behalf or at their direction, or entities owned or controlled by them, as designated by the Committee, and directs the Committee to designate such Libyan authorities, individuals or entities within 30 days of the date of the adoption of this resolution and as appropriate thereafter;
Affirmsits determination to ensure that assets frozen pursuant to paragraph 17 of resolution 1970 (2011) shall, at a later stage, as soon as possible be made available to and for the benefit of the people of the Libyan Arab Jamahiriya;”
highlightingthe importance of these institutions continuing to function for the benefit of all Libyans, and stressing the need for the Government of National Accord to exercise sole and effective oversight over the National Oil Company, the Central Bank of Libya, and the Libyan Investment Authority as a matter of urgency, without prejudice to future constitutional arrangements pursuant to the Libyan Political Agreement,
Endorsesthe Rome Communiqué of 13 December 2015 to support the Government of National Accord as the sole legitimate government of Libya, stresses that a Government of National Accord that should be based in the capital Tripoli is urgently needed to provide Libya with the means to maintain governance, promote stability and economic development, and expresses its determination in this regard to support the Government of National Accord;
Calls uponMember States, particularly those in the region, to continue to urge all parties in Libya to engage constructively with the Government of National Accord and all other institutions included in the Libyan Political Agreement and calls upon Member States to cease support to and official contact with parallel institutions that claim to be the legitimate authority but are outside of the Agreement as specified by it;
Further callsupon the Government of National Accord to protect the integrity and unity of the National Oil Company, the Central Bank of Libya and the Libyan Investment Authority, and for these institutions to accept the authority of the Government of National Accord;”
