CONCLUSIE
middelbevat de klacht dat het hof het verzoek tot het horen van [aangeefster] als getuige ten onrechte heeft afgewezen, dan wel dat het hof dit oordeel niet naar de eis der wet met redenen heeft omkleed. Deze klacht houdt verband met het onder 1A en 1B tenlastegelegde.
1. Een proces-verbaal van aangifte d.d. 31 juli 2015 (…), voor zover inhoudende als verklaring van [aangeefster] :

het hof begrijpt: naar het huis van [aangeefster]). Aldaar heb ik op een laptop gewerkt. Daarna ben ik met haar auto naar Amsterdam gereden. Ook heb ik de laptop meegenomen.’
Bewijsoverweging ten aanzien van feit 1A primair en 1B subsidiair
manifestly irrelevant or redundant’is. Deze overweging vindt steun in de uitspraak in de zaak Khodorkovskiy en Lebedev. v. Rusland, die onder meer inhoudt: [2]
‘712. The Government further claimed that the defence did not show the importance of the personal questioning of Mr Yeloyan and Mr Kupriyanov for the outcome of the trial. The Court cannot accept this argument. Both Mr Yeloyan and Mr Kupriyanov were hired as experts by the prosecution at the investigation stage and conducted their expert examination at the premises of the GPO, without any involvement of the defence (…). Consequently, their position was closer to that of a “prosecution witness”. Contrary to the situation with defence witnesses, the accused is not required to demonstrate the importance of a prosecution witness. If the prosecution decides that a particular person is a relevant source of information and relies on his or her testimony at the trial (…), and if the testimony of that witness is used by the court to support a guilty verdict (…), it must be presumed that his or her personal appearance and questioning are necessary, unless the testimony of that witness is manifestly irrelevant or redundant.’
‘77. The Court has already held, in its judgment in the case of Khodorkovskiy and Lebedev v. Russia (…) that if the prosecution decides that a particular person is a relevant source of information and relies on his or her testimony at the trial and if the testimony of that witness is used by the court to support a guilty verdict, it must be presumed that the personal appearance and questioning of that witness are necessary, unless his or her testimony is manifestly irrelevant or redundant. Given that the statements of A.G., K.O., Ş.Ö., H.K., N.Y., M.Ş., A.Y., C.P., V.T. and Mr Öcalan, as well as the transcripts of the applicant’s alleged telephone conversations were virtually the only evidence used in convicting the applicant (…), the Court must examine whether the first-instance court provided good reasons for the non-attendance of those witnesses at the trial.’
‘57. It does not appear that the Court of Appeal took the relevance of the testimony of witnesses A to G – or lack of it – into account when it decided not to accede to the requests of the applicant to call those witnesses, nor have the Government argued that the testimony of any of the witnesses would have been manifestly irrelevant or redundant.’

[10] Uw Raad overwoog dat de rechter het verzoek onder meer kan afwijzen ‘als hij tot het oordeel komt dat het (opnieuw) horen van de getuige voor de bewijsvoering van geen enkel belang zal zijn of geen toegevoegde waarde zal hebben (…). Voor het oordeel dat zich een dergelijke situatie voordoet, zijn onder meer van belang de inhoud van de in de tenlastelegging tot uitdrukking gebrachte beschuldiging, de andere resultaten van het strafrechtelijk onderzoek die zich in het procesdossier bevinden, zoals verklaringen van andere getuigen, en de procesopstelling van de verdachte, een en ander in het licht van het verhandelde ter terechtzitting waaronder wat daar mogelijkerwijs nog door de verdediging naar voren is gebracht over het doel van de beoogde ondervraging’. [11] ’s Hofs afwijzing van het verzoek op grond van het oordeel dat niet viel in te zien dat het horen van het slachtoffer van belang kon zijn voor enige in de strafzaak te beantwoorden vraag, was volgens Uw Raad niet onbegrijpelijk in aanmerking genomen dat de verdediging had verzocht het slachtoffer te horen over het tijdstip van een etentje van verdachte en een derde, waarover deze derde nog als getuige zou worden ondervraagd maar waaraan het slachtoffer niet had deelgenomen.
