espite the limitations imposed on it by procedural law with regard to the examination of facts, not only considered the grounds for cassation submitted by the author in his appeal in general, but also examined the evidence reviewed by the first instance court, upheld, in particular, that court’s conclusion that there was no reason to distrust Mr. Bekreev’s initial testimony, and concluded that the conclusions of the contested judgment regarding the facts of the case and the guilt of the author were well reasoned. In the light of the circumstances of the case, the Committee is of the view that the facts before it do not reveal any violation of article 14, paragraph 5, of the Covenant.” [23]
due to the lack of evidence that the Supreme Court sufficiently reviewed the facts and evidence in the author’s case, he was deprived of the effective exercise of his right to have his conviction and sentence reviewed by a higher tribunal” (onderstreping PG). Het Comité overweegt dat het arrest van de Hoge Raad “did not contain any reference or assessment of the facts or evidence used by the Court of Appeal to convict the author for the murder of mr. Stein” en “did not provide adequate details of its considerations of the lawfulness and sufficiency of the facts and evidence used and the reasoning of its re-assessments”. 81, eerste lid, RO bezigt. [26]
does not provide any substantive reasonat all as to why the court determined that it was clear that the appeal would not succeed, which
puts into question the existence of a substantial reviewof the author’s conviction and sentence. The Committee considers that, in the circumstances of the case, the lack of a duly reasoned judgment, even if in brief form, providing a justification for the court’s decision that the appeal would be unsuccessful, impairs the effective exercise of the right to have one’s conviction reviewed as required by article 14, paragraph 5, of the Covenant.” [28]
